There is a secret Memorandum of Understanding (MOI) between CHRC and the CF signed on January 20, 2005 and an Operational Memorandum of Understanding (OMOI) signed on October 20, 2005.

a. Please provide a copy of the final MOI as well as a copy of the various drafts exchanged between the CHRC and DND/CF;

b. Provide copy of any amendments produced pursuant to section 6.1 of the OMOI;

c. Pertaining to the OMOI (October 2005) at section 3.1.3 a Joint Working Group was mandated to explore the option of developing guidelines towards the usage of subsection 15(9) - Universality of Service - of the CHRA. Section 3.1.4 of the OMI, the signatories committed to meet to resolved human rights issues before a potential CHRC complainant would form a complaint. Request copies of all correspondence exchanged between CHRC and DND/CF to arrange and to host such meetings since 2005. Provide minutes - or similar document produced to records the results of each meeting, the names of participants and either the recommendations made, implemented or the decisions reached by this body.

d. Confirm whether complainants are being made aware of the behind the scene arrangements between CHRC/DND-CF provided for in section 3.4 OMOI which leaves the complainant out in the cold.
